The Office of the Director of Public Prosecutions has withdrawn murder charges against Jason Millette and Shalom Bailey in connection with the 2017 killing of Xavier Thomas in Cedar Grove.
Millette and Bailey were jointly charged with Dorian Marshall, whose conviction for the same offence was quashed last week by the Court of Appeal. The court ruled that the evidence presented during Marshall’s trial was insufficient to support a guilty verdict.
As a result, the appeal judges overturned Marshall’s 40-year prison sentence and barred any future retrial. In the wake of that decision, the DPP filed a nolle prosequi in the cases against Millette and Bailey, effectively bringing the prosecution to an end.
