The High Court has dismissed all charges against 27-year-old Jahciba Shoy after ruling there was insufficient evidence linking him to the 2023 robbery and fatal shooting of Roudi Shmaly at Pick ‘N Mix Mart on DeSouza Road.

Shoy had been on trial for murder, aggravated robbery and manslaughter. The case ended after defence attorney Wendel Alexander successfully argued that the prosecution’s evidence amounted to suspicion rather than proof.

The Crown relied on CCTV footage showing Shoy with the teenage gunman before the robbery and claimed a shoulder bag he carried resembled one later seen with the shooter.

“The evidence went no further than speculation and suspicion,” Alexander told ABS News.

The teenage gunman was previously convicted and served the maximum three-year sentence allowed under the juvenile sentencing laws in force at the time.
